Background: Our client, aged 78, brought a claim for clinical negligence following hospital treatment in June 2017, which led to severe complications.
Incident: Our client developed pressure ulcers that progressed from grade 1 to grade 4, along with the development of osteomyelitis. This caused short-term delirium and immobility, and in the long-term, worsened their Parkinson’s symptoms, increased care needs, and reduced life expectancy.
Investigation: We obtained expert reports from a care expert, tissue viability nurse, physiotherapist, and a consultant in Geriatric Medicine. The case was complex due to the pre-existing Parkinson’s disease, requiring us to disentangle the symptoms with the help of medical experts.
Challenges: Calculating a care claim was challenging due to the natural progression of Parkinson’s disease. We had to determine the extent to which our client would have recovered without the negligence.
Outcome: Despite these challenges, we secured a substantial settlement at mediation, ensuring our client received the compensation they deserved for the additional suffering and care needs caused by the negligence.
