I had been suffering with a pain in my hand for a while and I saw a doctor at the hospital about it. I was advised to have a straightforward operation which I was told would cure my problems. Everything seemed straightforward.

During the operation I felt a terrible sharp pain. I hit the roof. When the operation finished and the anaesthetic wore off I realised something was wrong. I couldn’t use my hand properly and it felt like electric shocks were going through my fingers. I hoped the pain would wear off but it did not. When it stopped me from doing simple things around the house and playing with my grandchildren like I used to I reluctantly decided to take legal advice to see whether there was anything I could do about it.

The solicitors came to see me at home. I found Neil and Mark easy to get on with. They took an interest in me and my case. They explained it clearly and did what they said they would do. I got a medical report from one expert who said I did not have a case and I thought the case would be over. Neil did not accept what he said and kept fighting for me. We got another report from another expert which said I did have a case. We involved a barrister who helped assess my case and I was told what to expect in compensation which I agreed with. We put my case to the hospital and told them what I would settle for. The hospital tried to argue that I did not have a case but my solicitors kept fighting for me and before Court action got under way the hospital agreed to my terms.

It was never too much trouble for Neil or Mark to come and see me at home and the way they fought for me after getting the report which said I did not have a case was very pleasing. I would recommend them.

Background: Our client, a keen triathlete and daily cyclist, was riding home through Hull city centre when he was knocked off his bicycle by an articulated lorry. The lorry, traveling in the same direction, turned left without indicating, dragging our client under the vehicle and causing extensive polytrauma and multiple fractures from head to toe.

Immediate Aftermath: Our client has no clear memory of the accident or the events for approximately six weeks following the incident. He underwent extensive rehabilitation and was discharged from the hospital five months post-accident.

Rehabilitation and Recovery: With the cooperation of the Defendant, we secured funding for his continued rehabilitation. This support, combined with our client’s determination, enabled him to make a miraculous partial return to work within six months of the accident. Remarkably, he returned to cycling and running within a year.

Legal Proceedings: The Defendant attempted to argue contributory negligence, but this had little merit. We successfully negotiated a pragmatic settlement before court proceedings were issued.

Importance of Rehabilitation: “This case highlights the importance of rehabilitation funded under the Rehabilitation Code, considering that liability had not been agreed by the defendant at this point,” commented Simon Burgess. “In cases where liability may be in issue, we can request that the Defendant fund rehabilitation outside the litigation process. This benefits both the client and the defendant by helping the client get back on their feet quicker. This support is invaluable as many clients struggle to access appropriate physio, occupational therapy, and other clinical support once discharged from the hospital.”

Our client had suffered with reduced hearing in their right ear since birth. In early 2020 a hospital referral in respect of this hearing loss was made and our client was subsequently listed for an operation to insert a right bone anchored hearing aid (BAHA). Our client was admitted for surgery in January 2021.

Following this surgical procedure our client awoke to feel pain around their left ear and quickly came to the realisation that the wrong ear had been operated on.

Our client was understandably upset and distressed to learn that the implant had been placed on the wrong side. As a result of this negligence our client unnecessarily required a further operation to remove the implant from the incorrect side and sadly developed an infection in the wound, which required antibiotic treatment.

Our client has been left with a visible scar to the left side of their head, approximately 50-60mm in length. The scar site remains painful and sensitive to touch and this symptom is likely to be permanent.

4 months after the first operation our client was admitted back into hospital to have the installation of the BAHA on the right side of their head.

As a further result of this negligent operation our client also experienced exacerbation of low mood, anxiety and depression.

Liability was admitted by the Defendant Trust and a five figure out of Court settlement obtained for our client.

“Emma White at SJP Law took on our case against the Consultant whom incorrectly operated on my husband’s ear. Emma was very thorough in all aspects of the case and explained every detail to us as the case progressed.

Emma kept in touch with the Consultant and psychologists to help make sure my husband received the best care whilst the procedure was corrected.

Emma has been fantastic, friendly, personable and very helpful in helping us reach a settlement with our negligence claim. We would thoroughly recommend Emma to anyone in a similar situation.”
